General Terms and Conditions (GTC) of VERDANORA

Applicability to Entrepreneurs and Definition of Terms

(1) The following General Terms and Conditions (GTC) apply to all deliveries between VERDANORA and consumers and businesses in their version valid at the time of the order. "Consumer" according to Section 13 of the Austrian Consumer Protection Act (KSchG) is any natural person who enters into a legal transaction for purposes that predominantly cannot be attributed to their commercial or self-employed professional activity.

Conclusion of Contract and Storage of the Contract Text

(1) The following provisions regarding the conclusion of the contract apply to orders placed via our website www.verdanora.com.

(2) A contract is concluded with VERDANORA and the owner Enis Sejdiju, located at Meschedeweg 3, 4030 Linz, Austria.

(3) The presentation of our products on the website does not constitute a legally binding offer, but rather serves as a non-binding invitation for the customer to order goods. By placing an order for our products, the customer makes a binding offer to conclude a purchase contract.

(4) The ordering process takes place in the following steps:

  • Selection of the desired product
  • Confirmation by clicking the "Order" button
  • Review of the items in the shopping cart
  • Clicking the "Proceed to Checkout" button
  • Registration in the online shop after registration and entering the registration details (email address and password)
  • Final review and, if necessary, correction of the entered data
  • Binding submission of the order by clicking the "Place Order" or "Buy" button

Before submitting the order, the customer can correct input errors by pressing the "Back" button of their browser or cancel the order process at any time. VERDANORA confirms the receipt of the order immediately with an automatically generated email ("Order Confirmation"). With this email, we accept your offer.

(5) The contract text is stored for orders placed via our online store. The GTC can be viewed at any time on our website.

Prices, Shipping Costs, Payment, and Due Date

(1) Our stated prices are final prices excluding shipping costs and do not include VAT in accordance with § 19 UStG (small business regulation) since we are a small business. Shipping costs may be added.

(2) The customer has the option to pay via bank transfer, Klarna, PayPal, or credit card (Visa, Mastercard, American Express).

Delivery

(1) Unless otherwise stated in the product description, all of our offered items are generally ready for shipment. However, delivery may take between 14 to 35 days depending on the product’s manufacturing. Many of our products, especially jewelry, are made to order once the order is received. The delivery period begins in the case of payment via prepayment on the day after the payment order has been issued to the bank entrusted with the transfer, and for other payment methods, on the day after the contract is concluded. If the deadline ends on a Saturday, Sunday, or public holiday at the delivery location, the deadline is extended until the next working day.

Return and Right of Withdrawal

(1) Right of Withdrawal
The customer has the right to withdraw from the purchase contract within 14 days without providing any reason. The withdrawal period is 14 days from the day the customer received the goods. To exercise the right of withdrawal, the customer must inform us (VERDANORA, Enis Sejdiju, Meschedeweg 3, 4030 Linz, Austria, Email: support@verdanora.com) by means of a clear statement (e.g., a letter sent by post or email) of their decision to withdraw from this contract.

(3) Return Shipping Costs
The customer is responsible for the return shipping costs. These costs will not be refunded. We recommend that the customer adequately insure the return shipment, as we do not take responsibility for lost returns.

(4) Exclusion from the Right of Withdrawal
Products that are made to customer specifications (e.g., personalized jewelry) are excluded from the right of withdrawal, as they are specifically tailored to the customer’s personal needs. Additionally, perfume products are excluded from the right of withdrawal if the sealed packaging of the perfume has been opened, as it is not possible to return such products for hygiene reasons after opening.

(5) Perfume Return Exclusion
Perfume products are excluded from the right of return and withdrawal for hygiene reasons once the sealed packaging has been opened. If the perfume is returned in an unopened and undamaged condition, we reserve the right to review the withdrawal request. However, generally, the return of such products is not possible.

Warranty Rights

(1) If a product is defective at the time of delivery (warranty case), VERDANORA will replace it with a non-defective product or repair it at the customer’s choice, at VERDANORA's cost (subsequent performance). No warranty case exists if the product had the agreed-upon condition at the time of the transfer of risk. A warranty case does not exist, especially:

a) for damage caused by misuse or improper use by the customer,
b) for damage caused by harmful external influences (e.g., extreme temperatures, moisture, electrical stress, lightning).

(2) VERDANORA does not provide a warranty for defects caused by unauthorized service partners or improper repairs by the customer.

(3) If the desired subsequent performance requires disproportionate effort, the customer’s claim is limited to the other type of subsequent performance. VERDANORA may refuse subsequent performance in certain circumstances.

(4) If the customer sends the product for repair or replacement, they must remove any self-caused damages and not leave any additional items in the product. VERDANORA is not responsible for the loss of items left in the product unless the loss is clearly attributable to VERDANORA.

(5) VERDANORA is not liable for data loss. Before sending a product for repair or replacement, the customer should make backup copies of their data and deactivate any passwords.

Retention of Title

We retain ownership of the goods until the full purchase price has been paid.

Final Provisions

(1) Austrian law applies to these GTC and the entire contractual relationship. The provisions of the UN Sales Convention are excluded.

(2) If individual provisions of these GTC are invalid or unenforceable, the validity of the remaining provisions shall not be affected.
